Renderpeople Contest Terms & Conditions

1. Organising company

Organizig company of the competition „Renderpeople Contest“ („Competition“) is Renderpeople GmbH, Venloer Straße 476, 50672 Cologne, Germany („Renderpeople“).

2. Prize

The main prize is the prize money in the amount of USD 1,000.00 , which will be transferred to the winner by Renderpeople.

3. Participation

a) Participation in the Competition is exclusively subject to the Terms and Conditions. By participating in the Competition, the participant accepts the Terms and Conditions.

b) Any natural person as well as any legal entity, represented by an authorized natural person older then 17 years, is entitled to participate. Natural persons under the age of 18 are excluded from participation. Legal representatives and employees of Renderpeople as well as their relatives and inlaws of 1st and 2nd degree are not eligible to participate. Persons not eligible to participate do not receive a claim to a prize.

c) A person participates in the Competition by registering for participation on the Internet at “www.renderpeople.com/contest/”. If the participant is a natural person the registration is made by entering the first and second name, the date of birth of the participant and an e-mail address in the required input field. If the participant is a legal entity the registration is made by entering the name of the legal entity, the first and second name and the date of birth of the authorized representative and an e-mail address in the required input field. Afterwards the participant must confirm the Terms and Conditions and press the button “Submit”.

d) The participant must attach to the online registration form a so called 3D rendered image or video, generated entirely on the computer, as a file. The image or video must contain at least one of Renderpeople’s 3D models (whether paid for or free). The image or video may not contain human 3D models from other providers. Images must have the file format JPG, PNG or TIF and a resolution of at least 1000px width. Videos must have the file format MP4 (h264, h265) and a resolution of at least 1280×720.

e) Participation in the Competition is only possible between August 1st and October 31st 2022.

f) Multiple participation in the Competition is not permitted. Each participating natural person can only participate in his own name. Prizes may not be transferred to third parties.

4. Obligations of the participants

a) If the participant is a natural person, the participant may only provide images and videos that he has personally and exclusively produced. If the participant is a legal entity, the participant may only provide images or videos of which he owns all necessary rights for this purpose. With the transmission of the images and videos, the participant assures that he has produced them personally and exclusively respectively that he owns the necessary rights for this purpose.

b) The participant assures that the use of the images and videos by Renderpeople does not violate the rights of third parties. In particular, the Participant will ensure that the use of the images and videos does not violate any personal rights, copyrights, trademark rights or other rights of third parties.

c) The participant assures that the use of the images and videos by Renderpeople does not violate any legal regulations. In particular, the pictures and videos may not contain any racist, pornographic or youth protection violating content.

d) In case the use of an image or video by Renderpeople violates one of the guarantees given by the participant, the rights of third parties or applicable law, the participant indemnifies Renderpeople from all third party claims including the costs of legal defense.

e) By submitting an image or video, the participant transfers ownership of the digital file containing the image or video to Renderpeople. Renderpeople accepts the transfer. By transferring ownership of the digital file the participant does not grant any further rights of use.

5. Determining of the winner

Among all legitimate participants the winner will be determined by an internal jury. The jury’s decision on the determining of the winner is exclusively a subjective one. The decision of the jury is final and cannot be (legally) reviewed or otherwise challenged.

6. Notification and distribution of prize

a) Renderpeople will inform the winner that he has won by e-mail to the e-mail address provided.

b) The winner must confirm by e-mail to info@renderpeople.com that he accepts the prize within three working days of receiving notification of the prize. In addition, the winner must provide Renderpeople with a telephone number in the e-mail in order to make the necessary further organisational arrangements.

c) In this case, the winner will receive a voucher code by e-mail. If the deadline is not met, Renderpeople reserves the right to select another winner.

d) Renderpeople does not pay the equivalent of the prize in cash. In the event of winning the prize, the participant declares that any costs and other services which are not advertised as a prize or as being included in the prize will be borne by him (in particular telecommunication fees). Claims for compensation by the winner initially determined against Renderpeople are excluded.

7. Licence / Obligations of the winner

a) The winner agrees that Renderpeople may use the name and other personality rights of the winner, the fact that he has won, and the winner’s image or video for a period of three months after the end of the Competition to advertise, for public relations and in general to promote the reputation of Renderpeople, as well as for editorial reporting on Renderpeople and the competition, including on the website, in the blog, in the newsletter and on all social media channels of Renderpeople.

b) The winner agrees to conduct an interview with Renderpeople on the topic of “Creation of the image / video”, which will be published in the Renderpeople blog. Renderpeople will send the winner a list of questions on this subject by email. The winner must provide Renderpeople with all necessary information and answered questions for the interview via email within seven days of receiving the questionnaire.

c) If Renderpeople requests, the winner will provide Renderpeople with the image or video in a higher format by email. The regulations according to Art. 4 of the Terms and Conditions apply accordingly.

d) With the transmission of the image or video as part of participation in the competition or according to foregoing lit. c), the winner allows Renderpeople to use the image or video – itself or through third parties – for the purposes of advertising, public relations and in general for the promotion of the reputation of Renderpeople as well as for editorial reporting on Renderpeople and the competition.

For this purpose, by submitting the image or video, the winner irrevocably and exclusively grants Renderpeople a royalty-free substantively, territorially and temporally, transferable and sublicensable right to use the image or video for all known and unknown types of use, including the right to publish, distribute, exhibit, edit, reproduce and publicly display it in non-physical form. The right of publicly display includes in particular the right of presentation, the right of broadcasting, the right of communication by image and sound carriers as well as the right of communication of radio broadcasts. The right of use shall be granted independently of the methods of transmission and reproduction and shall include in particular the right of use by electronic media, in particular the Internet.

8. Final provisions

a) Renderpeople is entitled, in the event of force majeure, changes in the legal situation or jurisdiction, due to an official or judicial restriction, for technical reasons or due to external circumstances not under the control of Renderpeople, to exchange the announced prize and replace it with another prize, to change the course of the Competition or the Terms and Conditions or to cancel or break off the Competition. In this case the participants and any winners who have already been determined are not entitled to any claims against Renderpeople.

b) If the participant violates the Terms and Conditions, Renderpeople is entitled at any time to exclude him from participation without prior notice.

c) The recourse of the courts is excluded. If one of the provisions of the Terms and Conditions is invalid, the remaining provisions shall remain.

d) German law applies to the exclusion of the UN Sales Convention.

9. Data Protection

a) Participation on and organization of the Competition

In order to participate in the competition, the participant must provide his first and last name, date of birth and e-mail address. The winner must also provide a phone number.

The date of birth must be given to check the right to participate. The other personal data will be processed only for the purpose of processing the competition. In the case of winning, Renderpeople will contact the winner to arrange the interview and advertising.

The data will be deleted after completion and settlement of the competition, unless there are no legal obligations to storage the data.

Data processing for the purposes of conducting the competition is based on the consent of the participant pursuant to Art. 6 Para. 1 Clause 1 lit. a) and lit. b) GDPR for the purposes of conducting the competition. In case of statutory storage obligations, processing is based on Art. 6 Para. 1 Clause 1 lit. c) GDPR.

The participant has the right to object to the processing of data at any time with effect for the future. The objection does not affect the legality of the processing on the basis of the consent until the objection. With the objection, the participant declares that he no longer participates in the competition.

b) Rights of the Data Subject

The applicable data protection law grants comprehensive rights of data subjects (rights of information and intervention) vis-à-vis the data controller with regard to the processing of personal data, about which we inform you below:

  • Right of access by the data subject pursuant to Art. 15 GDPR
  • Right to rectification pursuant to Art. 16 GDPR
  • Right to erase (“right to be forgotten”) pursuant to Art. 17 GDPR
  • Right to restriction of processing pursuant to Art. 18 GDPR
  • Right to be informed pursuant to Art. 19 GDPR
  • Right to data portability pursuant to Art. 20 GDPR
  • Right to object to processing pursuant to Art. 21 GDPR
  • Right to withdraw a given consent pursuant to Art. 7 (3) GDPR
  • Right to lodge a complaint pursuant to Art. 77 GDPR.

c) Controller in charge

The controller in charge for data processing on this website within the meaning of the General Data Protection Regulation (GDPR) is Renderpeople GmbH, Venloer Straße 476, 50825 Köln, Deutschland, Tel.: +49 2203 1836991, E-Mail: info@renderpeople.com. The controller in charge of the processing of personal data is the natural or legal person who alone or jointly with others determines the purposes and means of the processing of personal data.
